General provisions of the Regulations of Service Provision for COMPANIES
1. These Regulations of Service Provision concern the orders submitted electronically through the website www.translateasy.pl. Placing an order through the website www.translateasy.pl is tantamount to the acceptance of these Regulations by the Customer.
2. translateasy undertakes to perform the translation in accordance with the conditions of the order accepted by trenslateasy and the Customer, including the given realization date, payment provisions, the format of the source file, as well as the type of translation.
3. Translated texts are returned to the Customer in the same format as the source files, unless the Customer wishes otherwise. In such a situation the Customer must specify the format of the target text at the time of placing the order.
4. The size of one page is 1800 characters (including spaces). For settlement we use the sum of characters of the original (source) text. Individual orders are settled with accuracy to 0.5 pages.
5. Should there be the necessity to use specific nomenclature in the translation, the Customer must provide a glossary including all of the scopes of vocabulary that should be taken into account when performing a translation. Should there be no glossary provided, translateasy reserves a right to use proper vocabulary, although it may differ from the Customer’s wishes, in accordance with the best knowledge and professional practice of the translator.
Types of translations and the rates
1. Translations are divided into standard and certified.
2. Translations are performed in the following modes: normal, expedited and express in accordance with the information given on the appropriate sub site of the service www.translateasy.pl.
3. Translations intended for publication are subject to additional verification (+50% of the value of analogical order, which would not be for publication) on the side of translateasy and require the Customer’s acceptance. translateasy may require the possibility to consult with the Customer during the realization of the order intended for publication. The translations for publication require prior notification of this fact to translateasy.
4. Should the Customer not inform translateasy about the purpose of the translation, translateasy assumes that the text shall not be for publication and any additional verifications and corrections are additionally paid for after their order from the Customer.
5. Should the Customer not inform translateasy that the text is intended for publication, dissemination in the media or in any other form, translateasy reserves the right to refuse to make any free of charge corrections to the text proposed by the Customer, and which would be performed free of charge when realizing the order in the mode of translation intended for publication.
6. The rates and amounts provided for the types and modes of translations set out in paragraphs 1 and 2 are subject to change without prior notice, and any changes are reflected at the time of entering them on all the relevant sub sites of the service www.translateasy.pl.
Privacy protection
1. All Customer data are collected and processed by translateasy to properly realize the order.
2. translateasy takes all necessary measures to protect Customer’s personal data and any other available data, in particular including the texts for translation. translateasy reserves the right to make the original texts available to the people who cooperate with translateasy to realize the order.
Payments
1. In the case of the orders being paid for in advance, translateasy proceeds to fulfil the order on receipt of confirmation of the payment. For orders paid upon completion of the translation, translateasy provides the Customer with randomly selected fragments of translated text after translation. The entire translated text is delivered immediately upon receipt of confirmation of payment.
2. translateasy has the right to enforce payment in arrears and to charge statutory interest in arrears in accordance with applicable law.
3. The copyrights for translations shall be transmitted to the Customer at the time of payment of VAT invoice by the Customer. Upon payment of the invoice in full, the Customer acquires rights to make full use of translateasy’s translations in all fields of exploitation, except for the translations for publication. In the case of the use of translateasy’s translation for business purposes before paying the invoice, translateasy has the right to demand compensation from the Customer for the damage suffered by translateasy due to the unauthorized use of the subject of translation which is legally copyrighted.
4. In the case of texts for translation intended for publication, the copyright for translations shall be transmitted to the Customer at the time of payment of the full amount of the VAT invoice for the translation in question by the Customer. In the case of publication of the translated texts that were not originally reported as being subject to publication, the copyright for use on all fields of exploitation, including publication, will be transferred to the Customer after the payment of a surcharge of 25% of the original order value by the Customer. translateasy reserves the right to refuse to transfer the copyright for the translated texts which were not originally intended for publication, e.g. due to the fact that there may be some reservations to the translation, because of the mode of translation which did not cover additional proof-reading.
Run date
1. The completion date of the translation shall be the date specified in the order. translateasy is obliged to perform and provide the text before the expiration of the realization date.
2. Should translateasy fail to keep the term of the fulfilment of the order, the Customer’s account in translateasy will be credited with the amount of 5% of the value of the delayed order for every day of delay, however, this amount may not exceed 50% of the total order value. In the case of delays in the realization of orders that would exceed 10 days, the Customer has the right to cancel the Contract for the translation with translateasy without incurring financial consequences.
3. The maximum liability of translateasy for self-caused exceeding of the term of realization of the order is limited to the amount equal to 50% of the value of the delayed order.
Complaints
1. Any claims concerning the quality of translation must be reported to translateasy in 7 days from the date of the provision of the translated text. Not reporting complaints within 7 days from the date of the provision of the translation means that the Customer accepts the translation without any reservations.
2. In the case of justified complaints translateasy is obliged to remove the mistakes in the translation as soon as possible. translateasy may waive the right to remove mistakes, whereby the Customer is entitled to a refund of 50% of the paid amount corresponding to the fragments of the translated text, which would be found to be defective.
3. In the case of serious defects in the translation performed by translateasy, in justified cases, it is possible to withdraw from the contract for translation. In such a situation translateasy will return the entire deposited amount for the subject order within 7 working days from the date of acknowledging such an action by the equalizer of translateasy’s proof-reader.
4. The Customer is obliged to present the list of claims listing every questionable place in the complained translation together with the information about the type of the mistake and possibly the proposition of how to correct the subject of the service.
5. Complaints are not subject to: stylistics of the translation, graphic format of the translated document, the nomenclature used in the translation if it is correct. Complaints may be subject to: spelling errors, grammatical errors, substantial errors, gaps in translation, lost fragments of the translation.
Final provisions
1. translateasy is not responsible for any loss or damage incurred by the Customer in connection with the realization of the order. The extent and nature of translateasy’s responsibility is limited to cases mentioned in the Regulations of Service Provision.
2. In matters not regulated by these Regulations the relevant provisions of law shall supply.
3. These Regulations do not apply to consumers within the meaning of the Act on Competition and Consumer Protection dated 16th February 2007 (Journal of Laws No. 50, item 331, with later amendments) and the Act dated 23rd April 1964 - Civil Code (Journal of Laws No. 16, item 93, with later amendments).
